Chapter 7 is a "liquidation" bankruptcy. A major goal of the Chapter 7 filing is to protect valuable assets such as your home, vehicle, wages or retirement account. The trustee who is appointed in the Chapter 7 bankruptcy will collect all of the debtor's non-exempt assets and sell (liquidate) them to pay their debts, according to the priority of the debt. Some debts are non-dischargeable even by a Chapter 7 bankruptcy proceeding. This means that you will still have to pay the debt off, even after going through bankruptcy. Examples of non-dischargeable debts include student loans, child support, DWI fines and taxes.
Chapter 13 is a federal wage-earner repayment plan, designed to help individuals, married people and single-owner businesses pay back a portion of their debts. Chapter 11 is a reorganization proceeding generally used by businesses or by individuals who do not qualify for Chapter 13 but have assets that they do not want to lose in a Chapter 7 proceeding. The purpose of Chapter 11 is to provide a debtor with temporary relief from pre-filing debts while the debtor formulates a plan to restructure those debts under the specific requirements of the Bankruptcy Code. Senior Partner Michael Richmond has practiced bankruptcy law since 1976, having worked closely with a Chapter 11 Trustee. He recently became certified to do electronic filings with the Bankruptcy Court.
