Name Change

When a divorce is put through, a woman has the right to change her name. She has the ability to change her name to a prior name, her maiden name or any other name that she desires so long as it is not done for the purpose of:

  • Avoiding criminal prosecution; or
  • Avoiding creditors.

The Court will require her name, date of birth, social security number, as well as an affirmation that she is doing neither of the aforementioned things and is changing her name merely to disassociate herself from the marriage. However, many women choose to maintain their married name while there are still unemancipated children.
